Welcome to commsimpact.ae, which is the property of COMMSIMPACT FZE (“COMMSIMPACT”). COMMSIMPACT provides their proofreading and editing services to you subject to your acceptance of and compliance with the following terms and conditions. These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with https://www.commsimpact.ae website (the “Service”) operated by COMMSIMPACT FZE (“us”, “we”, or “our”). If you visit or purchase services or products or subscription from commsimpact.ae, you accept these terms and conditions. Please review them carefully.
These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms.
If you disagree with any part of the terms, then you may not access the Service.
In addition, when you use any current or future COMMSIMPACT service or product, or visit or purchase from any business affiliated with COMMSIMPACT, whether or not it is included in the commsimpact.ae website, you also will be subject to the guidelines and conditions applicable to such service or business. Note that this contains provisions that may limit your rights, such as under the section entitled “Disclaimer of Warranties and Limitations of Liability”.

Purchases
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Availability, Errors and Inaccuracies
We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other web sites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Intellectual Property
The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of COMMSIMPACT and its licensors. The Service is protected by copyright, trademark, and other laws of the United Arab Emirates. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of COMMSIMPACT.
Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by COMMSIMPACT. COMMSIMPACT has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that COMMSIMPACT shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third- party websites or services that you visit.

Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Limitation of Liability
In no event shall COMMSIMPACT, nor its founder, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

COMMSIMPACT, its subsidiaries, affiliates, and its licencors do attempt to be as accurate as possible. However, COMMSIMPACT does not warrant that product or service descriptions, other content of this site, or its services performed for its customers are accurate, complete, reliable, current, or error free. COMMSIMPACT, its subsidiaries, affiliates, and its licencors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

COMMSIMPACT reserves the right to change the services available through the site and their prices without any notice or liability. This site and COMMSIMPACT’s services are provided by COMMSIMPACT on an “as is” and “as available” basis and at your sole risk. To the fullest extent permissible pursuant to applicable law, COMMSIMPACT disclaims all warranties and conditions, expressed or implied, in respect of its services and any information, content, or materials on this site, including any implied warranties or conditions of fitness for a particular purpose, merchant ability, and non-infringement.

In no event is COMMSIMPACT, its employees, independent contractors, subsidiary and parent companies, affiliates, or any third parties mentioned on the site liable for any damages whatsoever (including, without limitation, direct, incidental, or consequential damages, lost profits, or damages resulting from lost data, breach of confidentiality, or business interruption) resulting from the performance of COMMSIMPACT’s services, the use or inability to use the commsimpact.ae site or the material contained on the site, whether based on warranty, contract, tort, negligence, strict liability, operation of law, or any other legal theory, whether or not COMMSIMPACT is advised of the possibility of such damages. In no event is COMMSIMPACT liable for damages in excess of the amount paid by a customer for the service in question. COMMSIMPACT has set its prices and created this site by reliance on the limitations of liability and disclaimers of warranties and damages set forth herein, and the same form a fundamental and essential basis of the bargain between the parties. They shall apply even if the contract between you and COMMSIMPACT is found to have failed in its fundamental or essential purpose or has been fundamentally breached. You specifically acknowledge and agree that COMMSIMPACT is not liable for any defamatory, offensive, or illegal conduct of any user. If you are dissatisfied with any COMMSIMPACT material, or with any of COMMSIMPACT’s terms and conditions, your sole and exclusive remedy is to discontinue using COMMSIMPACT services. While we endeavor to ensure that any files originating at this site are free of known computer viruses, we make no warranty or guarantee that files are virus free, and we are not able to provide any assurances with respect to email or attachments that may have originated with third parties. All recipients are cautioned to check all email, attachments, and other computer files before accessing them, and any and all risk of virus contamination is assumed by the recipient.

Governing Law
These Terms shall be governed and construed in accordance with the laws of United Arab Emirates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Electronic Communications
When you visit commsimpact.ae or send emails or WhatsApp us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email, WhatsApp or by posting notices on this site. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
License and Site Access
COMMSIMPACT grants you a limited license to access and make personal use of this site, but not to download (other than page caching) or modify any portion of it except with the express written consent of COMMSIMPACT. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product or service listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data-gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of COMMSIMPACT. You may not reproduce any image or depiction of this site as it might be rendered by a web browser or otherwise without express written consent from COMMSIMPACT. You may not use any meta tags or any other hidden text utilizing COMMSIMPACT’s name or trademarks without express written consent. Any unauthorized use terminates the permission or license granted by COMMSIMPACT. This site is owned and operated by COMMSIMPACT and is protected by UAE copyright and trademark laws. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way any material from this site, including code and software. Unauthorized use of any portion of this site beyond that contained in the previous paragraph may violate copyright, trademark, and other laws.

Authors/customers submitting material to COMMSIMPACT for service, retain copyright in such material, and COMMSIMPACT requires no other credit or acknowledgment for work completed other than the fees agreed upon with the author/customer. COMMSIMPACT does not claim any rights to such material by virtue of supplying its services, and will not use or disclose such material for any reason other than providing our services. You represent and warrant: that you own or otherwise control all of the rights to the material that you submit for service; that the material is accurate; that use of the material you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify COMMSIMPACT and/or its affiliates for all claims resulting from material you supply. COMMSIMPACT has the right but not the obligation to monitor and refuse any activity or content for any reason in its sole discretion. COMMSIMPACT takes no responsibility and assumes no liability for any material submitted by you or any third party.

COMMSIMPACT provides advice on changes that you, your publisher, or other third parties may accept, reject, or further amend. Content of any finished work is therefore entirely the responsibility of the author/customer or other persons to whom the author delegates, licenses, or otherwise assigns control over his or her work. Our work on any manuscript/draft does not imply any endorsement of its content or of the author. COMMSIMPACT expressly prohibits the association of COMMSIMPACT and any COMMSIMPACT trademark, editor, affiliate, or personnel with any published work, including by way of acknowledgment. Comments provided to the author by COMMSIMPACT and its personnel are provided for personal use only. Credit, rights, and acknowledgment for original works created by COMMSIMPACT and its employees will be negotiated on a case-by-case basis.

Customers
COMMSIMPACT is committed to providing exceptional editorial services at affordable prices. However, COMMSIMPACT is not obligated to refund the purchase price of any service and/or subscription package under any circumstance unless explicitly agreed to by COMMSIMPACT. If applicable, any refund will be granted in the original currency via the original payment method as per applicable business days which will be further advised. Price, terms, and availability are subject to change without notice. All prices quoted are in UAE dirhams unless otherwise stated. COMMSIMPACT reserves the right to limit quantities, to request payment prior to delivery of service, to refuse service, or to cancel orders at its sole discretion. Cancellation of an order by the customer may incur cancellation costs depending on how much work has been done on the document.

Purchase prices and invoices may be based on information that you provide to us, including the word count of the documents you are submitting for service (Please check FAQ for more information on the word count, what constitutes as one job within the subscription and other details). You represent and warrant that such information is accurate, and you agree to pay to COMMSIMPACT any additional charges arising from any inaccuracy in such information within seven days of notification thereof. COMMSIMPACT is not obligated to verify the accuracy of such information but will refund over payments arising from inaccuracy therein within specific business days, as mandated by the payment gateway, of the discovery thereof.

COMMSIMPACT may, at its sole discretion, offer specific invoicing arrangements to customers with specific requirements, and agree to additional or modified terms for such arrangements. Unless otherwise agreed to in writing, payment is due within 30 days after an invoice is rendered.

If you do not provide accurate contact information, or if you do not respond promptly if we require further information, we cannot be responsible for delays in providing the service.

If you create an account, a logon ID and password is required. It is your responsibility to protect that information, including without limitation, to use effective passwords that are not easily guessed or discoverable, and keep logon IDs and passwords confidential. You are responsible for any activity that occurs under your logon ID. You will advise COMMSIMPACT immediately if you discover any compromise of your passwords or suspect unauthorized use of the site using your identity.

Due to international privacy regulations and our constant commitment to protecting the confidentiality and security of our clients’ documents, access to completed files is restricted to 30 days. Please do not consider commsimpact.ae as a file storage platform. Please download and save your completed files within 30 days of completion of the job. After this time, we cannot guarantee that the file can be retrieved from the account space.

Other
This site and this agreement are governed by the laws of the United Arab Emirates.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time, by posting a notice on this site. If a revision is material, we will try to provide at least 15 days.notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
